Trademark registration in 2026: step by step
The goal of most entrepreneurs is to create or invent something unique, new, and innovative. Something that changes the world—perhaps not the entire world, but at least the one around you. The result of such activity is usually something intangible, whether in the form of a brand, a unique technical solution, or know-how, which in itself represents significant value that often constitutes the majority of a company's worth. A trademark is one of the most valuable assets you have as an entrepreneur. It protects your name, logo, or slogan from misuse and provides you with the legal tools to defend yourself if someone infringes upon your trademark rights.

What a trademark protects and why you should consider one

It can be a sign consisting of words, colors, or sounds, but it can also be the shape of packaging or a combinationof these. Once the trademark registration is entered into the register, no one else may use an identical or confusingly similar sign for the same or similar products and services if there is a likelihood of confusion.

By registering, you gain the exclusive right not only to use the trademark but also the legal tools to defend yourselfif someone interferes with the rights of the trademark owner. Without registration, your position is significantly weaker.

"In practice, I have dealt with situations where a client came to us facing a problem with a competitor who had started using the same packaging shape for their own gain. Confusion was occurring, and the client was losing significant amounts of money. They had underestimated the importance of a trademark and, as is often the case, kept putting off its registration.
Our options for defense were quite limited. In the end, we succeeded, and the competitor was forced to withdraw the similar packaging. I probably don't need to mention that by that time, we were already waiting for the trademark registration. If I can recommend one thing to you, don't wait to register," says attorney Martin Tůma.

Types of trademarks

Trademarks are categorized by how they are expressed. In practice, the vast majority of needs are covered by either a word mark or a figurative mark.

Depending on their form and nature, we distinguish between several types of trademarks:

  • Word mark (consisting exclusively of words or letters without graphic elements)
  • Figurative mark (e.g., a standalone logo registration, but also various combinations of text and graphics)
  • Three-dimensional trademark (consisting of a three-dimensional shape representing, for example, packaging or the product itself)
  • Position trademark (protects the placement of a mark on a product)
  • Pattern trademark (e.g., a repeating logo pattern on handbags)
  • Color trademark (consisting solely of a color or a combination of colors)
  • Sound trademark
  • Motion trademark
  • Multimedia trademark (a combination of image and sound)
  • Hologram trademark (consisting of elements with holographic features)

This list is not exhaustive, however; it is possible to register other types of trademarks that do not correspond to any of the types listed above. We will take a closer look at the most common types of trademarks in practice.

Word trademark

Protects the word or phrase itself – a company name, product name, or sloganA word trademark is the right choice when you primarily want to protect a phrase, regardless of how it is graphically designed.

"Be careful that your word trademark is not too generic or descriptive. A word that commonly describes a given product or service cannot become a trademark, and the office will reject such an application. No one can register 'dairy products' as a trademark,” warns the attorney, Vít Kučera.

Figurative mark‍

It protects a logo or other graphic element, whether it consists exclusively of a figurative element or a combination of word and figurative elements. It is suitable when people recognize you or your company by your logo. Unlike a word trademark, it protects the visual form, not just the wording or verbal expression.

Logo registration is the most common question we receive at endors in practice. A logo is usually the most visible part of a brand and it is specifically the figurative trademark that serves to protect it. This is why it is the type of trademark that clients usually want to register.

Logo registration vs. copyright

It is important to know that copyright for a logo and a trademark are two different protection tools. Copyright protects a logo as a work of art and arises the moment the work is expressed in an objectively perceivable form.

Copyright does not equal a protected logo

On its own, however, it does not guarantee that you will be the only person using the logo in business. That is what trademark registration is for, which allows you to prohibit others from using such a logo (with the exception of cases specified by law, for example, when the use of the given trademark is necessary to indicate the intended purpose of a product or service).

Three-dimensional, sound, or multimedia trademarks

The law distinguishes other types of trademarks as well. A three-dimensional trademark protects the shape of a product or packaging – a typical example is the Coca-Cola bottle. A sound trademark protects a jingle or melody. A motion trademark protects animations, specific gestures, or product opening mechanisms. A multimedia combination of sound and image. Protection also exists for colors, patterns, or holograms. In practice, however, these trademarks are rarely registered.

Collective trademarks

Members or associates of a legal entity may be interested in registering a so-called collective trademark. A collective trademark is a mark designated as such at the time of filing that is capable of distinguishing the goods or services of the members or associates of a legal entity from the goods or services of other persons.

Rights associated with a collective trademark

A collective trademark carries the exclusive right for the members or associates of the trademark owner who are listed in the register to use the mark to identify their goods or services. The best-known domestic example of such a mark is likely the designation ČSAD(Czechoslovak State Automobile Transport), which is still used by some transport companies today.

A specific feature of this trademark is that a collective trademark cannot be licensed, and furthermore, that a usage agreement must be submitted to the office when filing the application.

Certification trademarks

A certification trademark is a mark designated as such at the time of filing that is capable of distinguishing goods or servicesthat the owner of the trademark has certified for material, method of manufacture, performance of services, quality, accuracy, or other characteristics, from goods or services that are not so certified.

“A certification trademark can be perceived as a trusted symbol of quality. An application for its registration may be filed by anyone who is qualified to certify the given goods or services but does not themselves engage in business activities involving the supply of those goods or the provision of those services. In practice, however, this is a rare and underutilized type. You may, however, be familiar with the TÜV SÜD mark and its typical octagonal logo,” the attorney adds, Patrik Šimonek.

How to register a trademark step by step

Registration essentially consists of four steps.

  1. ‍Search – determining whether it is appropriate to register a trademark at all, and if so, for which territories.‍
  2. Selection of classes – defining what you are registering the trademark for, i.e., which products or services according to the relevant classification system.
  3. ‍Příprava a podání přihlášky.

Projití ochranné známky u ÚPV a EUIPO

Volba tříd výrobků a služeb ochranné známky

Příprava a podání přihlášky ochranné známky

Úřad průmyslového vlastnictví vás k obnově sám nevyzývá a žádost o obnovu zápisu ochranné známky je nutné podat nejpozději v den skončení doby platnosti.

Obnova ochranné známky není automatická

‍Pokud lhůtu promeškáte, ochranná známka zanikne a vám případně nezbyde nic jiného, než celý proces přihlášení ochranné známky absolvovat od začátku.

Námitkové řízení a zápis do rejstříku

Pokud registraci řeší advokátní kancelář, odměna typicky zahrnuje rešerši, volbu tříd, sestavení přihlášky, komunikaci s úřadem a případné řešení námitek.

Registrace ochranné známky v EU a mezinárodní ochrana

Ochranná známka EU

Pokud podnikáte i v zahraničí a přejete si, aby vaše označení požívalo ochrany i tam, nestačí vám registrace pouze pro území České republiky. This type of trademark protects your brand in all 27 EU member states at once. With a single application, you gain protection across the entire European market. The disadvantage compared to a national trademark, however, is the higher administrative fee, making an EU trademark application more expensive.

‍The fee for an EU trademark application starts (for electronic filing) at 850 EUR for one class of goods and services; there is an additional fee of 50 EUR for a second class, and 150 EUR for each subsequent class from the third one onwards. If you file the application using a paper form, the price starts at 1,000 EUR.

International trademark

If you need protection beyond the EU, the Madrid System allows for trademark registration in more than 130 countries worldwide through a single application filed via the World Intellectual Property Organization (WIPO). The advantage is that you manage the entire process centrally, and renewals or changes are made via a single application for all countries simultaneously.

However, for an international trademark to be registered, the specific trademark must already be registered for the territory of a country (e.g., at the IPO) or for the territory of the EU (at the EUIPO).

International registration

The price depends on the number of countries and the classes of goods and services. The basic fee at WIPO is 653 Swiss francs, though the specific fee amount varies based on the number of classes of goods and services and the countries in which the mark is to be protected. Of all the options, international protection is the most costly.

Trademark assignment

A trademark is an asset, and as such, it can be managed. It can be sold, gifted, or transferred to another person. The transfer must be recorded in the trademark register, otherwise it is not effective against third parties.

License agreement & trademark

Another option is a license. You do not have to transfer the trademark; instead, you grant a third party the right to use it under terms you define yourself. You remain the owner, but someone else can legally use your brand, such as a franchisee, distributor, or business partner.

What to do if someone infringes on your trademark

Registering a trademark is just the beginning. It is equally important to actively monitor whether someone is using it without authorization and to act quickly if that happens. We know how to stop trademark infringement and how to claim damages.
