We will provide an objective assessment of your situation

Compensation from the state is not guaranteed. It depends on exactly what happened, when you became aware of the damage, and how strong the causal link is—we will assess all of this for you before doing anything else. We will then be upfront with you about whether it makes sense to proceed and what level of compensation you can expect.

We will guide you through the entire process

Asserting a claim against the state has its own specifics. It begins with a request to the relevant ministry, not directly with a lawsuit. We know how this process works, what to watch out for, and how to avoid mistakes that could derail your claim before it even reaches court.

We will monitor all deadlines and dates

In this area of law, deadlines are short and missing them is irreversible. Non-pecuniary damage claims can only be filed within six months. Once we take on your case, we will track all upcoming deadlines for you.
Deadlines are unforgiving. Get in touch before it's too late
Domain disputes
We resolve global domain disputes. Prague is home to one of only five domain dispute courts in the entire world.
Proceedings are conducted through the Arbitration Court attached to the Czech Chamber of Commerce and the Czech Agrarian Chamber – one of only 5 accredited institutions of this kind worldwide. We can resolve your entire case with you in person at our Prague 1 offices – or remotely, as your representation in the Czech Republic.

Outcome of proceedings
A domain dispute before the Arbitration Court can end in one of two ways
1. Transfer of the domain to the applicant
The most common outcome of a successful dispute. The expert decides that the domain is to be transferred directly to you.
2. Cancellation of the domain registration
If you do not need to actively take over the domain, the expert orders its registration to be cancelled
And if the unauthorized registration caused you financial harm or damage to your reputation, we pursue that claim separately before the courts.
I want to resolve this
Don't let anyone profit from your brand. We can resolve your domain dispute, too.
Sometimes a competitor registers a domain identical to your trademark in order to exploit it – known as cybersquatting.

Other times, a speculator bulk-registers domains with the intention of offering them for purchase at an unreasonable price – known as domain grabbing.

A common form is typosquatting – registering variants of a domain with a deliberate misspelling. And then there are cases where someone uses your company name, personal name, or a well-known designation as a domain –without any entitlement to do so.

Whatever category your situation falls into, the important thing is to act quickly.

A "lawsuit against the state" can be the path to fair compensation
The state is liable for harm caused by unlawful decisions—in civil, administrative, and criminal proceedings—as well as for improper official procedure, most commonly the unreasonable length of proceedings.

Send us your case, and we will tell you straight whether it makes sense to proceed. We do not promise unrealistic results. But if there is a chance, we will do our utmost.

Facing a claim for the transfer of your domain?
Defence against a transfer claim

Domain disputes work both ways. If you have received a complaint, a pre-litigation notice, or an application initiating proceedings for the transfer of your domain, you need to act quickly and with expert support.

We assess the validity of the other party's claim, prepare a response to the application, and represent you throughout the entire proceedings.

Many claims for domain transfer are unfounded – and that is precisely why it is important to have a lawyer on your side who can distinguish a legitimate claim from mere pressure.

What determines the outcome of a domain dispute

Whether the dispute involves a .com, .eu, or .cz domain, the outcome rests on a three-part test. The applicant must demonstrate that the domain is identical or confusingly similar to their trademark, trade name, or other protected designation.

Furthermore, that the domain holder has no right or legitimate interest of their own in that designation. And finally, that the domain was registered or is being used in bad faith.

If you want to recover a domain, your application must succeed on all three points. If you are defending against a transfer claim, it is enough to challenge any one of them.

Compensation for damage caused by state authorities – FAQ
Consultation with an attorney

What you are entitled to and how to claim it

The state is liable for damage caused by its actions—even in cases where you do not have to prove fault. The law distinguishes between two basic scenarios.
‍
The first is an unlawful decision. This refers to a situation where a court or authority issued a decision that was subsequently overturned or amended due to illegality. Simply disagreeing with a decision is not enough—it must be formally overturned before a claim for compensation can arise.

The second is improper official procedure. This includes, for example, unreasonable length of proceedings.

A decision may be correct in substance, but if an authority or court acted too slowly and caused you harm as a result, you have the right to compensation.

Three conditions apply in all cases: state misconduct, the occurrence of harm, and a causal link between the two. Each of these has its own specifics that must be examined individually.

How to file a claim

The process differs from standard debt collection. First, an application must be filed with the relevant authority—usually a ministry. Court proceedings only come into play if the authority fails to satisfy the claim within six months of the application being filed, or if it explicitly rejects it sooner.

Lower court fees compared to other disputes

Compared to standard disputes, you have an advantage: the court fee is lower, and in the event of an unsuccessful outcome, you are not fully liable for the opposing party's legal costs.

Does it make sense to send a pre-litigation notice first?

In most cases, yes. Many disputes are resolved after a well-crafted notice from a lawyer, without the need to initiate formal proceedings. If an agreement is not possible, we proceed immediately to the next step.
