Says Martin Sklenička of JTH GROUP. We have been representing the company in the areas of development, construction, and litigation for several years now.
Says Petr Louma, Owner of L Construct s.r.o. – They always informed me of the realistic chances of (non)success and the various solution options. They have always provided me with high-quality representation.
Says Ivan Nestával, CEO of Ultina s.r.o., adding that they not only recommended an effective solution but also professionally resolved the problem for us.
What I appreciate most about our collaboration is the efficiency of the process and the professional approach of the entire team, along with their courage to find unconventional solutions to the situations that business reality presents to us, says manager Martin Gillar.
The state is liable for damage caused by its actions—even in cases where you do not have to prove fault. The law distinguishes between two basic scenarios.
The first is an unlawful decision. This refers to a situation where a court or authority issued a decision that was subsequently overturned or amended due to illegality. Simply disagreeing with a decision is not enough—it must be formally overturned before a claim for compensation can arise.
The second is improper official procedure. This includes, for example, unreasonable length of proceedings.
A decision may be correct in substance, but if an authority or court acted too slowly and caused you harm as a result, you have the right to compensation.
Three conditions apply in all cases: state misconduct, the occurrence of harm, and a causal link between the two. Each of these has its own specifics that must be examined individually.
The process differs from standard debt collection. First, an application must be filed with the relevant authority—usually a ministry. Court proceedings only come into play if the authority fails to satisfy the claim within six months of the application being filed, or if it explicitly rejects it sooner.
Compared to standard disputes, you have an advantage: the court fee is lower, and in the event of an unsuccessful outcome, you are not fully liable for the opposing party's legal costs.
The statute of limitations for property damage is three years from the day you became aware of the damage and the party responsible. The time limit for non-pecuniary damage is only six months.
The clock stops while the relevant authority is reviewing the application, but as soon as the authority rejects the claim, the clock starts running again. Missing the deadline means the court will dismiss the lawsuit, even if the claim would otherwise be valid.
