If you are filing a petition that is subject to a fee (e.g. a petition to register a company in the Commercial Register), the fee can be paid according to the court's instructions, for example by bank transfer to the court's account.

“Just don't forget that revenue stamps, which used to be a common way of paying court fees, can no longer be used today!” adds Hradec Králové lawyer Vojtěch Adámek.

Before you go to the regional court in HK – how to prepare

The basic rules for preparation are the same as for the district court (see our separate guide). A brief recap:

  • Bring: an ID, the summons, documents relating to the case, notes.
  • Dress formally: shirt + trousers + jacket (men), formal attire (women). No shorts, tank tops or sportswear.
  • Arrive early: the security check at the entrance is the same as at an airport.
  • It is prohibited to bring weapons, ammunition, explosives and other dangerous items into the court building

Where do I find my courtroom

The courtroom number is written on your summons (e.g. “door no. 112, 1st floor”). If you are not sure, go to the information center or ask the court security officers, who will be happy to help You find your way.

A specific feature of the regional court: a three-member panel

The key difference compared to the district court is that at the regional court, decisions are often made by a three-member panel (a presiding judge + two judges), especially in appeal proceedings and in serious criminal cases.

The formalities are therefore different from proceedings before the district court:

  • Address the presiding judge as “Your Honor” (in Czech, “pane předsedo” or “paní předsedkyně”).
  • The other members of the panel are judges and take part in the decision-making, but the hearing is usually conducted by the presiding judge.

Appeal proceedings at the regional court

Appeal proceedings at the regional court tend to be more formal and focused on the legal aspects of the case. The panel is usually very familiar with the case before the hearing and places emphasis on concise, factual and precise arguments. In appeal proceedings, the entire taking of evidence is therefore usually not repeated; the court focuses primarily on whether the court of first instance correctly established the facts and correctly applied the law.

If you are filing an appeal against a decision of the District Court in Hradec Králové, keep in mind that it may take several months for the regional court to issue its decision. In more complex cases or when the panel has a heavier workload, appeal proceedings may take more than a year.

Do I have to be represented by a lawyer?

Although representation by a lawyer is more pressing at the regional court than at the district court, in most proceedings the law does not require a lawyer. Nevertheless, a lawyer's help often pays off.

“A lawyer knows what evidence to submit, how to phrase motions and how to respond to the opposing party's arguments. As a result, you can focus on the dispute itself while leaving the procedural side of the matter to a professional. In many cases, a lawyer also helps prevent unnecessary mistakes that can prolong the proceedings or negatively affect their outcome,” says Hradec Králové lawyer Vojtěch Adámek.
